ST. LOUIS — The family of a man who was shot and killed at a north ÃÛÑ¿´«Ã½ gas station said Monday it is filing a wrongful death lawsuit to hold the business responsible.
John Christmas was shot and killed a year ago Monday at the Phillips 66 gas station and Crown Mart convenience store after a tussle over a gun. The shooter, Trevell M. Warren, was sentenced to seven years in prison.
Now, Christmas' family members, including his brother, local attorney Jerryl Christmas, say it was part of a pattern of dozens of dangerous incidents at the busy station on the northwest corner of Dr. Martin Luther King Drive and Kingshighway.Â

They filed a lawsuit last week claiming wrongful death, and Jerryl Christmas says he plans to lobby city officials to shut the business down because it's a nuisance.
"I'm past talking," he said.Â

But Jay Kanzler, who represents the gas station, said John Christmas was banned from the Crown Mart convenience store at the time he was killed for prior disruptive incidents.Â
"We never want something bad to happen," Kanzler said. "On the other hand, all of the security measures in the world aren't going to prevent people from arguing and fighting with each other if that's what they're intent upon doing."
